Sales Policy

1. Definitions

Platform: Refers to ementaonline.pt, a digital solution for displaying menus and product lists of commercial establishments.
Commerce: Refers to restaurants, cafés, or other establishments using the platform to showcase their products.
User: Refers to the consumer accessing the platform to consult menus and products.
Online Sales: E-commerce services, including financial transactions, that may be implemented on the platform in the future.

2. Current System Status

2.1. Product Display: The platform currently only allows businesses to showcase their products and menus. All transactions, including payments, are finalized directly at the establishment.
2.2. No Financial Transactions: At this stage, the platform does not provide any online sales or payment functionalities.

3. Future Online Sales Features

3.1. Tool Implementation: If online sales and financial transaction functionalities are implemented, these Terms of Sales will be updated to include additional provisions on the responsibilities of the platform, commerce, and users.
3.2. Prior Communication: Users and businesses will be informed in advance of any changes to the Terms of Sales involving the implementation of online transaction tools.

4. Responsibilities of Commerce

4.1. Product Information: The business is solely responsible for ensuring that the information about products, including prices, descriptions, and availability, is accurate and up to date.
4.2. Complaints and Warranties: Any issues regarding quality, delivery, or compliance of products must be addressed directly between the user and the business.
4.3. Legal Compliance: Businesses must ensure compliance with applicable Portuguese legislation, including Decree-Law No. 24/2014 (on distance contracts) and other consumer protection regulations.

5. Responsibilities of Users

5.1. Information Verification: Users are responsible for verifying the information provided by businesses before making any purchase.
5.2. Dispute Resolution: Users must report any issues directly to the business responsible for the purchased products.

6. Platform's Limitation of Liability

6.1. No Intervention in Transactions: The platform is not responsible for any transactions or agreements made directly between users and businesses at this stage.
6.2. Content Provided by Businesses: The platform is not liable for incorrect or outdated information provided by businesses.
6.3. Future Transactions: Once online sales are implemented, the platform's responsibility may be limited to technical issues related to the payment system, excluding liability for the products or services sold.

7. Changes to the Terms of Sales

7.1. Periodic Updates: These Terms of Sales may be updated periodically to reflect changes in legislation or platform functionality.
7.2. Notification: Users and businesses will be notified of any significant changes to the terms at least 30 days in advance.

8. Applicable Law and Jurisdiction

These Terms of Sales are governed by Portuguese law. Any disputes shall be submitted to the jurisdiction of the courts of Caldas da Rainha, unless expressly agreed otherwise.
